Terms of service
Last updated:
1. Agreement and scope
These terms govern your use of Afterform’s website, web workspace, mobile apps, and related services (“Service”), operated by MATSVEI SHULMAN IE (“Afterform”, “we”, “us”, or “our”). By creating an account, purchasing a plan, or using the Service, you agree to these terms. If you do not agree, do not use the Service.
The specific plan and purchase terms presented when you order form part of your agreement. A separately signed agreement controls where it expressly replaces these terms. Our privacy policy explains how we process personal information. Nothing in these terms excludes rights or remedies that applicable law does not allow us to exclude.
2. Accounts and eligibility
You must be at least 18 and legally able to enter this agreement. If you use the Service for an organization, you confirm that you have authority to bind it. Provide accurate account and billing information and keep it current.
You are responsible for safeguarding your credentials, managing access you grant to collaborators, and activity you authorize through your account. Notify us promptly if you suspect unauthorized access. You may not transfer or sell your account without our permission.
3. The Service and third-party tools
Afterform provides a workspace for media creation, including supported image, video, audio, and 3D workflows, assets, reusable records, and project collaboration. Availability depends on your plan, platform, region, and the tools currently offered. A roadmap, example, or preview is not a promise to deliver a future feature unless expressly included in your purchase agreement.
Some operations rely on third-party models, infrastructure, or stores. Their availability, rules, and technical limits can change. You must follow provider restrictions disclosed for a tool you use. We may substitute or remove providers and models subject to the paid-service protections in section 5.
4. Subscriptions and payments
Before purchase, review the price, currency, taxes, billing interval, included credits, limits, and any introductory offer shown at checkout. Unless clearly sold as a one-time purchase, your subscription renews automatically for successive periods of the stated length until canceled. You authorize recurring charges at the agreed price, subject to the change process in section 5 and any consent required by law or your purchase platform.
Introductory discounts apply only for the period stated in the offer; the disclosed regular price applies afterward. An annual subscription is a purchase for the annual term, even if its price is also shown as a monthly equivalent. We may offer different prices or promotions by platform, region, or customer group, subject to applicable law. A later promotion does not automatically entitle earlier purchases to a price adjustment.
Polar handles web purchases. Apple or Google handles purchases made through its store, under the applicable store purchase rules. You remain responsible for valid charges incurred before cancellation. We may restrict paid access if payment fails or is reversed, subject to applicable notice and remedy requirements.
5. Changes to plans, prices, and features
We may introduce, change, replace, or discontinue plans and features, including prices, discounts, credit allowances, generation rates, model access, storage, seats, concurrency, and usage limits. For existing customers, valid reasons include changes in supplier or operating costs, taxes or legal requirements, security and abuse prevention, provider availability, technical compatibility, capacity, or changes needed to maintain or develop the Service. Changes must be proportionate to their reason and remain subject to this section and applicable law.
New offers may take effect immediately for new purchases. For an existing subscription, an increased recurring price or a material reduction in the purchased plan’s included allowance takes effect no earlier than the next renewal, after reasonable advance notice by email or another durable means. The notice will explain the change, its effective date, and how to cancel before it applies. We will give any longer notice and obtain any affirmative consent required by law or the purchase platform. We do not retroactively increase charges for a billing period already purchased.
During a paid period, we may update or replace features for the reasons above without an additional subscription charge. If a change materially reduces your paid access or use, we will provide reasonable advance notice and the right to end the affected service without penalty and receive any refund required by law. Urgent legal, security, or provider restrictions may require faster action, but do not remove your mandatory remedies. Where legally required, we will explain the option to keep the unchanged service or terminate within the applicable statutory period.
Unless we expressly agree otherwise, renewal does not guarantee a permanent price, a particular model, or an unchanged feature set. You may cancel future renewal if you do not accept a proposed change. Continuing to use a paid period does not by itself authorize a new charge that requires your express consent.
6. Credits, generation costs, and limits
Credits measure access to supported operations within Afterform. They are not money, a deposit, or an investment, and cannot be transferred, resold, or redeemed for cash except where required by law. Credit grants, validity, and any rollover are those stated for your purchase; do not assume unused credits carry forward unless the offer says so.
The credits required for an operation can vary by model, settings, duration, and other inputs. Review the price or estimate shown before submitting. We may change rates for future operations for the reasons in section 5; we will not retroactively reprice a completed operation. A credit balance does not guarantee a fixed number of future creations or permanent access to a particular provider, subject to any specific purchase commitment.
Generations can be delayed, rejected, or unsuccessful. Credit adjustments depend on the operation’s billing outcome and any applicable refund rights. Disliking an otherwise delivered result does not by itself entitle you to a free retry or refund. Any “unlimited” feature remains subject to its disclosed scope, technical capacity, and reasonable controls against abuse; it does not remove separately stated credit, concurrency, or plan limits.
7. Cancellation and refunds
You can cancel renewal through the billing portal for a web purchase or the subscription settings of the Apple or Google account used to purchase. Cancel before the next renewal according to the purchase platform’s stated cutoff. If you cannot access cancellation, contact [email protected]. Ordinary cancellation stops future renewals and leaves paid access available until the end of the current term.
Except as required by law, the applicable store rules, an express purchase promise, or another provision of these terms, payments are non-refundable and we do not issue partial refunds for unused time, unused credits, or a change of mind. This does not limit remedies for a failure to supply, defective service, or a qualifying material change. A refund or reversed payment may result in removal of the associated access and unused credits.
Consumer cancellation and withdrawal rights vary by location. Where a cooling-off period applies, early supply affects that right only after any legally required express request, consent, and acknowledgment. Merely accepting these terms does not waive a statutory withdrawal right. Contact us or the relevant purchase platform to exercise it.
Uninstalling an app or ceasing to use the Service does not cancel a subscription. Manage renewal with the original purchase platform before deleting your account, particularly for App Store and Google Play subscriptions.
8. Your content and permissions
You retain your rights in content you upload. As between you and Afterform, and to the extent permitted by law and applicable third-party rights, you retain any rights you acquire in generated content. AI content may not be unique, copyrightable, accurate, or free of third-party rights. We do not promise exclusive ownership or clearance for a particular use.
You grant us a non-exclusive, worldwide license to host, copy, process, transmit, and display your content only as needed to provide and secure the Service, fulfill your instructions, resolve support requests, and comply with law. This includes passing required inputs to providers and displaying content to collaborators or recipients you authorize. The license lasts for those purposes, including applicable retention and deletion periods described in the privacy policy.
You must have the rights and permissions required for your inputs and intended use, including copyright, trademark, privacy, publicity, face, and voice permissions. Review creations before publishing or using them commercially. You are responsible for required disclosures, permissions, and compliance for your use; the Service does not provide legal clearance or professional advice.
9. Acceptable use
You must not use the Service to:
- Break the law, infringe intellectual property, violate privacy, or use a person’s face, likeness, or voice without the rights or permission required for that use.
- Create or distribute child sexual abuse material, non-consensual intimate content, fraudulent impersonations, or content that unlawfully threatens, exploits, or harasses others.
- Bypass safety controls, payment requirements, access restrictions, or usage limits; exploit promotions through deceptive accounts; or resell access without permission.
- Introduce malware, interfere with the Service, access another person’s data without authorization, or conduct automated extraction or attacks that disrupt the Service.
10. Suspension and termination
We may restrict content or suspend or terminate access for a material breach, unlawful activity, nonpayment, fraud, a security risk, or a legal requirement. Where appropriate and legally required, we will explain the reason and allow an opportunity to resolve the issue. Immediate action may be necessary to prevent harm or comply with law. You may contact support to contest an action.
We may retire the Service or decline a future renewal with reasonable notice. If we end a prepaid service for our convenience before its term ends, we will refund the unused portion of the affected prepaid term and honor any further mandatory remedies. Termination for a breach does not create a refund entitlement beyond applicable law or an express purchase commitment.
Keep independent copies of important content. After access ends, content may become unavailable and will be handled under our privacy policy and any applicable export or retention duties. Accrued payment obligations and provisions intended to survive termination remain effective.
11. Disclaimers
To the fullest extent permitted by law, the Service and generated content are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent they can lawfully be disclaimed. We do not guarantee uninterrupted access, error-free operation, a particular generation time, creative result, commercial outcome, or continuing availability of a specific model.
AI can produce inaccurate, inappropriate, or unexpected content. You should independently assess it before relying on it. Beta or experimental features may change or be withdrawn. These statements do not override express purchase commitments, legally required service standards, or consumer guarantees.
12. Limits on liability
To the fullest extent permitted by law, Afterform and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, business opportunities, goodwill, or data arising from use of or inability to use the Service, regardless of the legal theory and even if advised of the possibility.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these terms is limited to the greater of USD 100 and the amounts you paid for the Service in the 12 months immediately before the event giving rise to the claim. This is an aggregate limit, not a limit for each claim.
These exclusions and limits do not apply to fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. They do not restrict mandatory refunds, consumer remedies, or statutory data protection rights. Where a limitation is not permitted, liability is limited only to the extent the law allows.
13. Business customer indemnity
If you use the Service in a business capacity, to the extent permitted by law you will indemnify Afterform against third-party claims, resulting damages, and reasonable legal costs to the extent caused by your unlawful content, infringement of third-party rights, or material breach of these terms. This does not cover claims caused by our own breach, negligence, or willful misconduct. We will promptly notify you, allow reasonable control of the defense, and provide reasonable cooperation. No settlement may impose an admission or non-monetary obligation on us without our consent. This section does not apply to consumers acting outside their trade or profession.
14. Our intellectual property
We and our licensors retain rights in the Service’s software, design, branding, and other materials apart from your content. We grant you a limited, non-exclusive, non-transferable right to use the Service under these terms while your access remains valid. No other rights are granted except those required by law.
15. Changes to these terms
We may revise these terms to reflect changes in the Service, legal requirements, security needs, or business operations. We will publish the revised version and update the date above. For material changes affecting existing customers, we will give reasonable advance notice by email or another durable means, explain when they take effect, and provide any required opportunity to reject them or end the affected service.
Changes apply prospectively and do not remove rights already accrued. Continued use after the effective date signifies acceptance only where legally sufficient; we will obtain express agreement where required. Subscription price and plan changes remain subject to section 5. If you disagree, stop using the affected Service and cancel future renewal, without losing any mandatory remedies for the current term.
16. General terms and disputes
If a dispute arises, contact us so we can try to resolve it. This does not prevent you from contacting a regulator, exercising a statutory remedy, or bringing a claim in a court available to you under applicable law. Nothing here requires mandatory arbitration or deprives consumers of protections under the mandatory laws of their place of residence.
If a provision is unenforceable, the rest of these terms remains effective to the extent legally possible. A delay in enforcing a right is not a waiver. We may transfer this agreement with a merger, reorganization, or sale of the business, subject to legally required notice and without reducing mandatory consumer protections. Events beyond our reasonable control may delay performance, but do not remove mandatory refund or other consumer rights.
